Ben Affleck and Jennifer Garner reportedly have no prenuptial agreement in place.
The pair’s 10th wedding anniversary took place on Monday June 29, but on Tuesday June 30 the estranged couple confirmed they are calling it quits on their marriage.
TMZ reports Ben and Jennifer did not sign a prenuptial agreement before tying the knot, however, it’s claimed they aren’t concerned in the slightest over how their marital assets will be divided in divorce court.
According to
Celebrity Net Worth , Jennifer has a $40 million fortune while Ben’s estimated net worth is $75 million.
Many have speculated the pair decided to hold off on their divorce until after they reached their ten-year wedding anniversary in order to adhere to California’s Family Code Section 4336, a state legal decree that defines a union lasting longer than a decade as a marriage of “long duration”. Under Family Code Section 4336, a family court judge has the power to determine which party gets spousal support, how much said party receives in alimony and the magistrate also has full jurisdiction over the duration of the alimony settlement.
But sources tell TMZ the timing of their divorce announcement has nothing to do with this legal code.
“It's unlikely she'll get spousal support because of her wealth, but she doesn't need it,” the website writes. “The trick is dividing the property, which we're told is going smoothly so far.”
Apparently Ben and Jennifer have hired business managers to oversee asset allocation.
The former couple, who share three young children together, are supposedly determined to end their union amicably.
People magazine reports the pair plan to continue living on the same property during divorce proceedings.
“They don’t want this to be War of the Roses,” a source told Us Weekly magazine. “They want it to be simple and this takes the drama out of it. It is important for them to keep this nice and efficient for the sake of their family.”
