Olivier Martinez will not be criminally prosecuted for assault, according to reports.

The Frenchman was involved in an incident at Tom Bradley International Terminal at LAX in January as he travelled with wife Halle Berry, her daughter Nahla, six, and the couple's 18-month-old son Maceo. He was alleged to have rammed an empty baby seat into a member of staff at the airport who had tried to snap a picture. The employee fell backwards on impact and was said to have been taken to hospital after suffering pains in his abdomen.

However, on Tuesday law enforcement sources are thought to have told TMZ that the LA City Attorney will conduct an office hearing. This will see Olivier and the LAX employee share their versions of events and the S.W.A.T. actor will "probably get a warning" and the case will be closed.

Anger management could be made part of the deal for the 49-year-old, the outlet added.

Olivier was believed to be concerned with the amount of paparazzi surrounding his family on their arrival at the terminal. Both he and Halle, 48, have spoken in the past about how much they want to keep their offspring out of the limelight.

They have even considered moving back to Olivier's home country of France, where paparazzi laws are much stricter. However, Nahla's father Gabriel Aubry opposed the move in a custody battle.

Halle and Olivier, who married in July 2013, a few months before their son was born, are also firm supporters of the No Kids Policy, which sees websites agree not to use images of celebrities' children.
