Kelly Rutherford was “clearly delighted to be with her kids” in light of her child custody snafu.

The 46-year-old Gossip Girl actress has been in a six-year legal battle with ex-husband Daniel Giersch over the care of their two children, son Hermés, eight, and daughter Helena, six.

Last week a judge in California ruled the state no longer has jurisdiction over the case, which means Kelly must start the fight for guardianship all over again in the state of New York.

But despite her recent court loss, it seems she is making the most of having her children over the summer.

Kelly attended the Ovarian Cancer Research Fund's Super Saturday charity event with her tots. And a representative for Aquaball tells People magazine she was “clearly delighted to be with her kids” at the affair.

"They were partaking in all the different activities, visiting different booths and enjoying the day," the Aquaball spokesperson detailed. "At one point she took them over to a children's play area where her daughter painted and she played an interactive game with her son. She donned a flower crown at one point that she got from one of the booths."

Kelly and her tykes were drinking Aquaball, a sugar-free flavoured water beverage, throughout their time at the charity bash last weekend.

Kelly’s former spouse Daniel has been living in Monaco with their offspring since his visa was revoked in 2012. And in June a judge in Monaco, the principality that holds jurisdiction over the custody matter, ruled Kelly can have the children over the summer.
