Sam Worthington and his girlfriend have been summoned to court after clashing with a photographer last year.
The Avatar actor welcomed his first child with fellow Australian Lara Bingle this month. But on Sunday, it was confirmed that the new parents will have to leave their baby at home to attend court and answer questions about an alleged altercation they had with a photographer last year.
“Defendants shall be deposed not later than April 10, 2015,” US District Judge Lorna Schofield wrote in her order, according to British website MailOnline.
The couple will have to talk about their altercation with photographer Sheng Li, who has filed a $10 million lawsuit.
The paparazzo alleges he was “viciously assaulted and battered” by the stars "without any just cause or provocation" on a Manhattan street on February 23 last year.
He claims he suffered a shoulder tendon tear and injuries to his right thumb, wrist, facial contusions, abrasion, lacerations, mental anguish and post-traumatic stress.
As well as having to face the photographer’s lawyers, Sam and Lara will also have to pay for his LA airfare, hotel and travel time after the judge took into account the model’s recent motherhood keeping her in California.
But despite their legal woes, the couple are said to be loving the new addition to their family.
“The baby was coming any day for the last week. Their families came in and they've been staying at his place…" an insider told Us Weekly. "Sam couldn't be happier."
Sam and Lara chose to keep mum on her pregnancy, but she was photographed with a growing baby bump while out and about in Los Angeles and New York City.
